Market Mobile operates as APS Commerce Ltd, a company registered in England and Wales. These terms govern the services we provide, including the purchase, assessment, and recycling of devices, and are binding upon your agreement to sell or return devices through our platform.

2. Terms of Agreement

2.1 By submitting your device(s) for sale or return to us, you agree to these terms and conditions.

2.2 Please read the document carefully before proceeding with any transactions, as it outlines the responsibilities of both parties.

4. Formation of Contract

4.1 Submission: Submitting your device(s) for sale forms an offer to sell. A contract is created only after we confirm receipt and approval of your device(s).

4.2 Order Accuracy: You are responsible for accurate order submissions, including correct device details.

4.3 Ownership: By submitting devices, you confirm you are the sole owner and have the authority to sell them.

4.4 Data Removal: It is your responsibility to erase all personal data from devices before sending them to us. We are not liable for any data breaches resulting from failure to erase data.

5. Device Grading

Devices are graded based on condition and functionality. Below are the grading criteria we use:

5.1. Grade A – New Condition

  • Device is unused, in original packaging, with seals intact.
  • Fully functional with no marks, scratches, or signs of wear.

5.2. Grade B – Excellent Condition

  • Device is in near-perfect condition with minimal wear.
  • Screen and body are free from scratches, cracks, or chips.
  • Fully functional with original parts.

5.3. Grade C – Good Condition

  • Device shows light wear, such as minor scratches or scuffs.
  • No cracks, chips, or significant damage.
  • Fully functional with original or high-quality replacement parts.

5.4. Grade D – Fair Condition

  • Device has noticeable wear, including multiple scratches or minor dents.
  • Fully functional but may have replacement parts.
  • No cracks or severe structural damage.

5.5. Grade E – Poor Condition

  • Device has heavy wear, visible damage, or multiple dents.
  • May have replacement parts but is still functional.

5.6. Damaged – Grade D & E

  • Device is cracked, chipped, or missing components.
  • May be functional or non-functional.
  • Examples: cracked screens, damaged buttons, or degraded batteries.

5.7. Beyond Economical Repair (BER)

  • Device is non-functional or damaged beyond repair.
  • Examples: water damage, motherboard issues, or severe structural damage.

6. Pricing

6.1 Prices are guaranteed for 14 days from order submission. Devices received after this period may receive revised offers based on market value.

6.2 Prices include VAT where applicable.

6.3 Final price determination is at our discretion after evaluation.

7. Postage and Returns

7.1 Sending Your Device:

  • Devices must be sent securely packaged to prevent damage during transit.
  • Use Royal Mail Tracked services; devices valued over £100 should have additional insurance coverage at your own expense.

7.2 Loss or Damage in Transit:

  • We are not liable for devices lost or damaged in transit. Customers may claim compensation directly from Royal Mail or their shipping provider.

7.3 Device Returns:

  • If your device does not meet our grading criteria, you can request its return.
  • Returns are processed for a fee of £10.00 to £30.00, depending on the device's value and insurance requirements.

8. Returns Process

8.1 Customers wishing to request a return should email returns@marketmobile.co.uk, providing the following:

  • Order number.
  • Device model.
  • Reason for return.

8.2 Payment of Returns Fee: Once approved, you will receive a secure link to pay the returns fee online.

8.3 Returns Timeline: Devices will be shipped back to you within 5 working days of payment confirmation.

9. Payments and Ownership

9.1 Payment is processed after device evaluation and approval.

9.2 Payment is made via the method selected in your order form (e.g., bank transfer, PayPal).

9.3 Ownership of the device transfers to us upon payment or recycling.

10. Flagged Devices

10.1 Devices flagged as lost or stolen through GSMA checks will not be paid for or returned.

10.2 Quarantined devices flagged for legal issues will be destroyed or handed over to the authorities if unresolved within 28 days.

11. Events Beyond Our Control

11.1 We are not liable for delays or failure to meet obligations caused by events outside our control, including postal disruptions or force majeure.

12. Complaints

12.1 If you have a complaint, contact us at sales@marketmobile.co.uk. We aim to resolve complaints within 7 working days.

13. Use of Personal Information

13.1 Your personal data will be processed in accordance with our Privacy Policy.

14. Other Important Terms

14.1 These terms are governed by English law. Any disputes will be resolved in English courts.

14.2 If any part of this contract is deemed unenforceable, the rest remains in effect.

14.3 We reserve the right to amend these terms. Changes will be posted on our website.
